Module Title: SJPD New Enquiries
Refer/Defer Task 1: Portfolio (100%)
Ensure that you read the whole of this document as it includes important information on your Refer/Defer task.
Word Limit: 3,000 words in total (you may split this up as you see fit across Part 1 and Part 2; but suggested splits are provided below).
You MUST complete Part 1 and Part 2. You MAY include documents in an optional Appendix to supplement your work if you wish to do so.
Part 1: Case Study (suggested word count – 2,250 words)
Prepare a New Enquiry Case Study for the Senior Solicitors in SHU Law based on the attached new enquiry form from Lucas Jones. Your New Enquiry Case Study will be used to decide whether SHU Law Limited can assist Lucas with his enquiry.
Your New Enquiry Case Study should include:
Identification of what if any actions Lucas may be able to take in relation to his legal issue;
Research into the law that is applicable to Lucas’ matter and into any legal tests that he may need to satisfy to pursue legal action;
Identification of any further information or evidence that Lucas may need to provide to pursue legal action;
Research into the legal processes or procedures that would need to be followed for Lucas to make a claim, including any required pre-action steps, any time limits on making any application or claim and an outline of the likely stages that would be encountered in a court claim;
An outline of any professional conduct considerations that SHU Law would need to be aware of when taking on this or any other new matter.
Part 2: Reflection (suggested word count – 750 words)
Identify the key skills and attributes that are likely to be required of a law graduate in 2022, and, using a suitable reflective model, reflect on how you have worked towards developing those skills during your second-year studies (making specific reference to the New Enquiries module) and what actions you could take to support your future academic and professional development.
Your Case Study and Reflection must both be OSCOLA referenced and must refer to appropriate sources, including any applicable primary sources and any relevant secondary sources that you identify.
Optional Appendix (documents in the Appendix are not included within the word count)
You may wish to complete independent research (using the Research Record form) to support your Case Study and Reflection If you choose to do so, your Research Records should be placed within the Appendix to supplement your work. Any documents within the Appendix will not count towards the word count but will be looked at during the marking process.
Your Case Study and Reflection must both be OSCOLA referenced and must refer to appropriate sources, including any applicable primary sources and any relevant secondary sources of commentary that you identify.
