THE FACTS:

The Swiss company LogiSwiss, based in Bern, wishes to send its senior technician, Mr. Hergé, a Belgian citizen, to Montreal to visit its client, the Quebec arms company Principal Dynamics and Tactical Systems (“Principal Dynamics”), based in Repentigny and specializing in the design and production of ammunition.

Mr. Muller, head of LogiSwiss, consults you and explains the following:

During his stay, which could last up to 3 months (or longer if necessary), Mr. Hergé will carry out several missions on behalf of LogiSwiss:

  • Install software designed, developed, and sold by LogiSwiss to Principal Dynamics;
  • Train employees of Principal Dynamics and of the Montreal-based company Rheinsecurity Canada, which regularly provides IT support to Principal Dynamics, in the use and updating of new surveillance software;
  • If Principal Dynamics so wishes, inspect all IT equipment and various software of different brands used by the company and make the necessary improvements so they are compatible and function efficiently with the new software sold by LogiSwiss.

To cover Mr. Hergé’s accommodation and living expenses in Canada, Principal Dynamics has proposed to give him the final contract payment upon arrival, in order to avoid unnecessary currency transfer costs.

Furthermore, to amortize the cost of the trip, Mr. Muller has other business development ideas. He would like Mr. Hergé to take advantage of his stay to provide, at a very competitive rate, some technical support services to other Canadian arms companies with which LogiSwiss has already had initial contact. This would be an opportunity to build new relationships with potential clients.

While providing these services, Mr. Hergé could also assess their needs for modernization of equipment and software and then propose new contracts for the design and sale of software that LogiSwiss could develop for them.

Mr. Muller believes, based on his internet research, that no formal application is required prior to departure for this type of business visit thanks to the Free Trade Agreement with Europe, and asks you to confirm this.

Mr. Muller also wonders whether the fact that Mr. Hergé told him he was born in the United States could make things easier. He specifies that during his stay in Canada, Mr. Hergé may need to return to Switzerland to meet urgent client needs, so he must be able to leave Canada and re-enter if necessary.

Mr. Muller also wants to ensure that Mr. Hergé will indeed be able to carry out the various planned assignments without difficulty during his visit to Canada. Last year, according to Mr. Muller, after a business trip to Sinaloa, Mexico, Mr. Hergé was refused entry into the United States by land for the same type of visit because he did not have a work permit. Clearly, the U.S. Immigration and Customs Enforcement officer did not understand the context. Mr. Muller hopes that Canadian agents are more competent than their American counterparts and, of course, wants to avoid a similar situation.


CASE ANALYSIS:

  1. What answers to his questions and, following your meeting, what advice and recommendations will you give Mr. Muller regarding this project?
  2. Explain to Mr. Muller the application(s) to be submitted for Mr. Hergé’s entry into Canada (specify the practical modalities of submitting these applications—where, when, how—and indicate the precise regulatory source [article, paragraph, subsection] where applicable), so that he fully understands the requirements.
