Rebecca rented 5 booths at an Airshow Fair to be held on 9th Dec. Rebecca was responsible to renovate the booth in accordance with the design given by the organisers by 5th Dec. If she fails to do so, her deposit would be forfeited and she would not be allowed to operate the booths.
In addition, she would still be liable for the unpaid rentals. Rebecca engaged a contractor Roger on 15th Nov to renovate the 5 booths to be completed by 3rd Dec for $5,500. The amount was payable upon completion. After renovating the first two booths, Roger found that the work was more complex than he had thought. On 30th Nov, Roger informed Rebecca that he was using more materials than anticipated and that he may not be able to complete the work by 3rd Dec. He asked for an extra $300 more for the materials.

Rebecca agreed to add this $300 to the original $5,500. As Rebecca was worried that the work could not be completed on time, she told Roger that she would pay an extra $1,000 if Roger could engage more workers to complete the renovation by 3rd Dec. Roger engaged more workers and completed the work by 3rd Dec. He asked Rebecca for payment on 10th Dec.
Rebecca told Roger that the business of the booths was bad and she could only afford to pay Roger the original amount of $5,000 for full settlement. Roger reluctantly agreed but later he discovered that Rebecca‘s booths were doing good business during the fair. He now wants Rebecca to pay the additional $1,300 he was promised.
Advice Roger.
