Chapter 9 in the Understanding Property Law text discusses the different classifications of estates in land (i.e., the type and nature of the different interests in land that a person, or a legal entity, can hold). The classifications of estates in land remain important in today’s legal system because they remain in use. Since the fee simple is the predominant estate in use, this practical exercise will show some of the options available when one transfers title to property by sale, gift, trust, or will.
Chapter 10 of Understanding Property Law covers different types of concurrent ownership. Concurrent ownership involves the labels, rights, and duties in which 2 or more persons or legal entities can concurrently own title to property. Concurrent ownership speaks to the relationship between and among the owners of the land.
INSTRUCTIONS: A. For the Chapter 9 portion of the assignment on Estates in Land
Select 2 of the 3 types of freehold fee simple estates. You are required to write an outline summary of 2 of the 3 types of freehold fee simple estates—either the 1. fee simple absolute,
2. the fee simple determinable, 3. or the fee simple subject to condition subsequent—with the following information: • a definition of each of the 2 selected fee simple estates
• a description of owner’s rights and duties of each of the 2 selected fee simple estates
• an example of the language and instrument that effectively creates each of the 2 selected fee simple estates
• an example of the language or event that effectively terminates each of the 2 selected fee simple estates
B. For the Chapter 10 portion of the assignment on Concurrent Ownership, Select 2 of the 3 types of concurrent ownership. You are required to write an outline summary of 2 of the 3 types of concurrent ownership—either 1. the tenancy in common, 2. the joint tenancy, 3. or the tenancy by the entireties—with the following information:
• a definition of each of the 2 selected types of concurrent ownership
• a description of owners’ rights and duties of each of the 2 selected types of concurrent ownership
• an example of the language and instrument that effectively creates each of the 2 selected types of concurrent ownership
• an example of the language or of an event that effectively terminates each of the 2 selected fee simple estates
The required examples listed above must be obtained from a court opinion, a legal treatise, or a case cited in the textbook’s footnotes. Do not use the author’s examples.
Written as a Word document, the paper must use the framework of an outline for insertion of the required information in a succinct, brief manner, as follows:
• The outline must be at least 3 pages, with 1-inch margins, left justification, and paginated at the bottom-center of the page.
• The outline must use footnotes that reference the legal authority for all definitions, descriptions, and examples.
• A minimum of 4 references are required for each of the two selected Estates and another 4 references for each of the two selected Concurrent Ownerships, for a minimum of 16 footnote citations.
• The footnotes must be cited according to the current Bluebook: A Uniform System of Citation. • To illustrate the outline format, use the template example below:
