Instruction(s): Please respond to the following four questions, using no
more than 500 words per answer, for a total of 2,000 words. Each
question will be weighted equally. The final exam is worth 55% of your
final grade. Please limit your discussion to the facts as given in the
hypotheticals (to the extent the question relies on a hypothetical): don’t
discuss or assume additional facts. Please do not to rely on any outside
legal research beyond what we learned in class, and the textbook. Please
do not contact me to discuss the exam, even after you have submitted it.
Do not discuss or share the exam with others. I expect that every student
will take seriously their responsibility to behave professionally, operate
within the permitted guidelines of this exam, and avoid any temptation
to seek an unfair advantage. Failure to follow these rules represents a
form of academic misconduct and is subject to the normal penalties for
such misconduct.

that rely on suspect classifications. Do you agree or disagree with these
three tiers, and why? What would you change about them were you
given the chance to do so?

Question 3: Assume the injured director files a civil negligence claim
against Alec Baldwin. Discuss whether he will be successful. Use the
IRAC format. In your application section, discuss whether the husband
might consider suing anyone else, and why.
Question 4: A prosecutor wants to criminally charge Alec Baldwin with
violating a statute prohibiting first degree murder, because the
cinematographer shot by Baldwin died. Assume the New Mexico statute
defines first degree murder as: “The intentional killing of another person
by someone who has acted willfully, deliberately, or with planning.”
Discuss the prosecutor’s burden of proof, and whether he will be
successful. Use the IRAC format.
