The Building Code can be downloaded from www.employment.gov.au/building-code. ‘Commonwealth funded building work’means work in items 1-8 of Schedule 1 of the Building Code. ‘exclusionsanction’has the same meaning means as in the Supporting Guidelines. ‘FWBC’means the Fair Work Building Industry Inspectorate, which is known and operates as Fair Work Building and Construction. ‘Supporting Guidelines’ means the Building Code 2013 – Supporting Guidelines (April 2016). The Supporting Guidelines can be downloaded fromwww.employment.gov.au/building-code. ‘the Project’ means the works to be executed through the funding provided by the Commonwealth. The Tenderer’s attention is drawn to the Building Code and the Supporting Guidelines.Tenderers should be aware that the Building Code applies to:the Project which is the subject of these Tender Documents; andall building work described in Schedule 1 to the Building Codeundertaken by the Tenderer thereafter, including privately funded building work.As part of the tender response, Tenderers must submit a signed “Declaration of Compliance” which is attached to this Request for Tender.By submitting an expression of interest or tender (however described) to undertake the Commonwealth funded building work you will be deemed to have read and agree that you (and any related entity) will comply with the Building Code.Consistent with Section 5.1 of the Supporting Guidelines, a contract for Commonwealth funded building work must not be entered into with a building contractor or building industry participant if:there are reasonable grounds to believe the building contractor or building industry participant is covered by an enterprise agreement that is inconsistent with the Building Code; orthere are reasonable grounds to believe that the building contractor or building industry participant is a party to an agreement of a kind described in subsection 10(1) of the Building Code; oran exclusion sanction applies to the building contractor or building industry participant; oran adverse decision, direction or order of a court or tribunal has been made in relation to the building contractor or building industry participant and a contravention of any of the following in respect of building work: a designated building law; orthe Work Health and Safety Act 2011 or a corresponding WHS law; orthe Competition and Consumer Act 2010; and, there are reasonable grounds to believe that the building contractor or building industry participant has failed to comply with the decision, direction or order. Each Tenderer must indicate in its Tender response:Thatthe Tenderer is not covered by an enterprise agreement that is inconsistent with the Building Code.that the Tenderer is not a party to an agreement of a kind described in subsection 10(1) of the Building Code;that the Tenderer is not subject to an exclusion sanction;whether the Tenderer or a related entity of the Tenderer has ever been subject to an exclusion sanction;whether the Tenderer has had an adverse decision, direction or order of a court or tribunal made against it for a contravention of a designated building law, the Work Health and Safety Act 2011 or corresponding WHS law or the Competition and Consumer Act 2010, and the tenderer has failed to comply with the decision, direction or order.how the Tenderer and its related entities have complied with the Building Code in the past (if the Tenderer and/or its related entities has undertaken Commonwealth funded building work in the past);how the Tenderer intends to comply with the Building Code in performing the Contract, should it be the successful Tenderer; andwhere the Tenderer proposes to subcontract an element of the project, either:the information detailed in the above subclauses (a) and (f) in relation to each subcontractor, orhow the Tenderer intends to ensure each subcontractor complies with the Building Code.Notwithstanding any other provisions of the Tender Documents, Tenderers hereby consent to the disclosure of information concerning compliance with the Building Code, including details of whether or not an exclusion sanction has been imposed. This consent extends to disclosure by the Commonwealth, the Director of FWBC and Minister for Employment for the purposes of facilitating compliance with the Building Code. Tenderers must ensure that their proposed subcontractors are also aware of, and agree to comply with, these rights of use and disclosure. Copies of the Building Code are available at www.employment.gov.au/building-code.Compliance with the Building Code shall not relieve the Contractor from responsibility to perform the Contract, or from liability for any defect in the works arising from compliance with the Building Code.Where a change in the Contract is proposed and that change would affect compliance with the Building Code, the Contractor must submit a report to the Director of FWBC specifying the extent to which the Contractor’s compliance with the Building Code will be affected.The Contractor must maintain adequate records of compliance by it with the Building Code.The Contactor must maintain adequate records of compliance with the Building Code by its related entities and subcontractors.If the Contractor does not comply with the requirements of the Building Code in the performance of this Contractsuch that a sanction is applied by the Minister for Employment, without prejudice to any rights that would otherwise accrue, funding entities or funding recipients (as the case may be) shall be entitled to record that non-compliance and take it, or require it to be taken, into account in the evaluation of any future tenders that may be lodged by the Contractor or a related entity in respect of Commonwealth funded building work.The Contractor must not enter into a contract with a subcontractor where: a) there are reasonable grounds to believe the building contractor or building industry participant is covered by an enterprise agreement that is inconsistent with the Building Code; or there are reasonable grounds to believe that the building contractor or building industry participant is a party to an agreement of a kind described in subsection 10(1) of the Building Code; oran exclusion sanction applies to the building contractor or building industry participant; oran adverse decision, direction or order of a court or tribunal has been made in relation to the building contractor or building industry participant and a contravention of any of the following in respect of building work: a designated building law; orthe Work Health and Safety Act 2011 or a corresponding WHS law; orthe Competition and Consumer Act 2010; and, there are reasonable grounds to believe that the building contractor or building industry participant has failed to comply with the decision, direction or order. The Contractor will, and will requireits related entities and its subcontractors to, provide the Commonwealth or a person occupying a position in FWBC, with full access to the premises and records of the above-mentioned entityto: inspect any work, material, machinery, appliance, article or facility;inspect and copy any record relevant to the Project the subject of this Contract; andinterview any person as is necessary to demonstrate its compliance with the Building Code. The Contactor will agree to a request from the Commonwealth or any person authorised by the Commonwealth,includinga person occupying a position in FWBC, to produce a specified document within a specified period, in person, by fax, by electronic means or by post.The Contractor will ensure that its related entities and its subcontractors will agree to the requests in clause 10.The Contactor consents to disclosure by the Commonwealth, the Director of FWBC and Minister for Employmentinformation concerning its and its related entities’ compliance with the Building Code and whether or not an exclusion sanction has been imposed on it and/or its related entity. Contactors must ensure that their subcontractors are also aware of, and agree to comply with, these rights of use and disclosure.
