Hospitality Law – Assignment #3Our course focuses on Risk Management in the Hospitality Industry. We realize that the nature of the business brings with it great risks. Risk occurs under obligations assumedunder contracts (Contract Law) and those assumed merely because we all have an obligation not to causeharm to others (The Law of Negligence or Tort Law). We, realistically, cannot eliminate risk… but, we can manage risk. To successfully manage risk, we mustbe aware of where the risk exists so that it can be both recognized and addressed. This is the conversation that we have had and which emanates from the subject matter that is canvassed inchapters 5 to 11 in the text and which we discussed in class. For assignment #3, view yourself as the new owner of a medium sized hotel. It has four floors, indoor andoutdoor parking, a restaurant, a bar, a swimming pool, an exercise room, some rooms with balconies, asmall convention/meeting room. It is located in Toronto. You are requested to make a comprehensive list of all of the distinct areas within the hotel. Note all of theobvious and not so obvious concerns that you must address to ensure that all is safe for both employeesand guests. Think hard about every little detail as to where potential liability might occur.Remember, in class we discussed:• The House and Grounds• Fully Public Areas• Dining Rooms and Banquet Halls• Guest Areas Outside the Guest Rooms• Inside Guest Rooms• The Back of the House (Kitchen and Maintenance Areas)• Safety and Security• Special Considerations for Special Needs Customers• Food Standards, Ingredients, and Health Concerns• Liability for Alcohol MisuseThe above are merely some general examples. Each, has many additional considerations within it wherepotential risk exists. You do not need to write an essay. Rather, clearly and concisely list the potential risk factors within thishotel to demonstrate that you are aware of their existence. What potential harm and liability could resultfrom these risk factors. How would you go about monitoring these risk factors to prevent liability claimsand, therefore, potential loss.
