Include case law and statute in your report. case study; Athena Gyms Athena Gyms You have recently been appointed HR Manager for Athena Gyms, a group of 6 gyms, each situated in towns in the Midlands. The company has almost 100 staff but has not had an HR Manager before. Each gym employs one full time manager and one deputy manager. You are informed that the remainder of the gym staff are on zero hours contracts. Alpha Gym On your first day Adonis, the manager of Alpha Gym, contacts you to say that he has been interviewing for a new fitness instructor and all the applicants except one are men. He would like to appoint the woman applicant because, although she is less qualified than some of the men who applied, he does not currently have any female fitness instructors. Many women customers have indicated that they prefer a woman. There was an accident last week when a customer slipped in the women’s changing room. They had to ask the cleaning lady, Agatha (employed through an agency), to go in and investigate as she was the only female member of staff on site. She found the floor was slippery but Adonis did not allow her to write it in the accident book as he was worried about getting sued. She is threatening to go to the police if this isn’t resolved. Adonis has asked the agency to replace her. Adonis also wants to talk to you about one of the fitness instructors called Adrian. He has asked to take time off for an adoption appointment as he is adopting a child with his same sex partner. Adonis did not realise Adrian was gay until he made the request. Adrian has told Adonis that he now feels that he is getting the cold shoulder from the other staff at the gym but Adonis says that in reality he doesn’t fit in with the team. Adonis asks you whether you could negotiate an exit for Adrian; asking him to leave and paying him a month’s wages in return for him to signing a confidentiality agreement. Beta Gym Hera, the Managing Director, has forwarded you an email from one of the new fitness instructors at Beta Gym. She is asking for a written contract. Hera informs you that she only gives written contracts to the managerial and office staff. She explains that the fitness instructors are ‘casual’ and ‘zero hours’ and she would prefer not to put anything in writing as she does not want to be pinned down to specific obligations. Finally Cressida, manager of Beta Gym, has sent you an email to ask what she should do about her deputy manager, Helena. Helena has been coming into work late for her shift. When Cressida challenged her about this Helena broke down in tears and told her that she believes she is suffering from Chronic Fatigue Syndrome and is finding it hard to cope. However Cressida can see from Helena’s Facebook page that she has a very active social life.
