On January 6, 2021, we witnessed something that we never thought we would see–we witnessed an insurrection. As a result, the former President of the United States was impeached by the House of Representatives, but acquitted by the Senate. He was charged with inciting an insurrection. Now aside from that there are potentially other legal issues at play. One of those potential legal issues you should have read about–vicarious liability. So your discussion question for this week is as follows: If you were the prosecutor, do you believe that you could make out a plausible case of vicarious liability to charge the former President (DT) with murder for the deaths of five individuals which occurred during the insurrection–why or why not?
