Michael was employed as a journalist for The View newspaper for 3 years. Two weeks ago, he failed to meet a deadline, and the next day, when he turned up for work fifteen minutes late, he was told that he was being dismissed for misconduct and to collect his belongings and leave. Sarah was also a journalist with the paper. When she began working at The View, she was the political correspondent and occupied an important position within the paper. Over the last few months, the main political stories have been given to Colette, a new employee, and Sarah was asked to write “human interest” stories. Sarah felt marginalized and isolated. Michael was her only ally in the organization and since he has been fired, her supervisor has made her life a misery. She has just seen her doctor, who has diagnosed severe stress. Sarah feels as though she cannot continue to work on the paper. Discuss the legal issues arising from both Michael and Sarah’s situation

Fergus is the Human Resource Manager for Jackson Developments Ltd. He participates in all interviews of candidates who have applied for positions with the company. Rosemary is the chief executive, and she chairs all the interview panels. Last month, the company advertised for the post of Finance Officer. There were 30 applicants, of whom 5 were invited for an interview. John McDonagh was one of the applicants who was not invited for an interview. John phoned Rosemary to ask why he was not invited for an interview, and she told him it was because he was “one of the McDonaghs from Limerick” and she didn’t want their kind working in the company. This was a reference to a family who is a member of the traveling community in the phone call. When the interviews took place last Tuesday, Rosemary asked Mark, one of the candidates why he was applying for the job at this stage of his career. Mark is 55 years old and all the other candidates are in their thirties. Mark was not successful in the interview. John and Mark have now complained of unfair treatment and Fergus needs to report to the board on the legal implications. Fergus has asked for your advice – write an account of the legal issues arising from this scenario
