Consider that you are the defense attorney for one of the following scenarios. Choose one of the scenarios below for your response. Respond to a classmate who chose a different scenario than you. Be sure to identify which scenario you selected for your response.
Scenario I
Arthur McDowell was charged with raping his 14-year-old daughter. The prosecutor also charged the mother with conspiracy to commit rape because she knew about the rape and bought the condoms for her husband to use when committing the crime. The mother claimed she did not contact police because her husband threatened to kill her and the daughter. Based on the provided information, should the mother be charged? Which defense would you use to defend the mother’s actions? In your response, be sure to state your reasons for the recommended defense.
Scenario II
Faith Eubanks is addicted to heroin and voluntarily checks herself into a drug treatment program. An undercover police officer joined the same program to gain information about local drug suppliers. He befriends Faith and asks her to purchase some heroin for him. She refuses on four occasions. On the fifth occasion, however, she succumbs and buys him two balloons of heroin. She is arrested for possession. Should Faith be charged? Which defense would you use to defend her actions? In your response, be sure to state your reasons for the recommended defense.
